Czech Republic: Towards regulation of cannabis and kratom by 2025

Starting in July 2025, the Czech Republic will allow the regulated sale of kratom and cannabis with a maximum THC content of 1%. This decision marks a significant step in the regulation of low-risk psychoactive substances, while maintaining the ban on the recreational use of high-THC cannabis. This reform is part of the Psychomodulatory Substances Act, adopted last year, which aims to legally regulate certain psychoactive substances.

Which substances will be regulated?

The new regulations focus on substances considered to pose a low risk to public health and society, based on scientific research. These substances include:

  • Cannabis with a maximum of 1% THC : This product has low psychoactive potential and is intended for controlled use. Extracts and tinctures meeting this THC limit are also included.
  • Kratom and Kratom Extracts : This plant, known for its stimulant and analgesic properties, will also be regulated.

Substances such as HHC (hexahydrocannabinol) and its derivatives, previously prohibited, are currently under evaluation but are not yet among the authorized substances.

How will regulation work?

The sale of these substances will be strictly regulated. Here are the main measures:

  • Only specially designated stores will be able to sell these products.
  • Age restrictions will be applied, and access to minors will be prohibited.
  • Sales through vending machines are explicitly prohibited.
  • Online sellers will need to have a physical store.

Retailers will also be required to ensure product quality and provide detailed information on composition and recommended dosages to customers.

Categories of psychoactive substances

The law on psychomodulatory substances classifies substances into three categories:

  1. Banned Addictive Substances : These substances, such as heroin and methamphetamine, pose a high risk to public health.
  2. Substances under evaluation : New psychoactive substances, whose effects are not yet fully understood, are studied for up to two years. HHC and its derivatives currently fall into this category.
  3. Psychomodulatory substances : These substances, such as kratom and low-THC cannabis, are considered safe for regulated sale under strict conditions.

A unique position in Europe

With this new legislation, the Czech Republic stands out in Europe by introducing a regulated system for low-risk psychoactive substances. Unlike other European Union countries, where the CBD trade is permitted without specific regulations, the Czech Republic is adopting a more structured and controlled approach.

For consumers, this regulation provides legal and safe access to low-risk substances while protecting public health. For businesses, it represents an opportunity to develop a regulated market with clear standards and quality guarantees.
